As most of you know, for the past fifteen months or so, the makers of Clonus have been in litigation with Dreamworks & Warner Bros. about The Island. Producers Robert Fiveson and Myrl Schreibman, as well as scores of people online, contend that Michael Bay poached their idea when making The Island. You can see our interview here. Yesterday, Judge Shira Scheindlin set a date for trial: February 22, 2007. Based on publicly available court records it appears that there have been several rulings of interest. DW and WB had requested the case be dismissed, but were denied as well as being denied a request for summary judgment and a motion in limine to exclude certain evidence. Basically it all means that the good guys have won an early victory. Other highlights include that the plaintiffs will be allowed to call to the stand certain people involved in making The Island, e.g. Steven Speilberg, Jeffrey Katzenberg, Michael Bay, as well as writers. There are also questions (on the record from Bay) about the accounting records and how much money the movie did or didn't make. This link will take you to a pdf with most of the judgments. Now if The Clonus people win (which it so far seems may happen), will they just get money out of the deal, or will The Island be taken out of DVD circulation, or something else?

Yeah, I have to agree DW and WB most likely see a big defeat coming their way, so they'll more then likely settle out of court.

Maybe they'll change the credits so Fiveson can get SOME kind of recognition.

Yep, out of court, definitely. WB can't afford a lengthy action at the present writing, nor can they afford bad publicity - and plagerism is bad publicity. ESPECIALLY if you're (obviously) guilty.

As a writer, I'm really disgusted by all this and hope the Clonus people gets loads of money.
Also Bay should think about hanging himself in disgrace as his career is really a complete waste of time anyway.

Clonus was a real thought-provoking movie...hope this works out well for the directors of it...or am I too late? ;D

I watched it last night, & it sure provoked a lot of thoughts in me.
One of which was indeed - "hey! The Island ripped this film right off!"
How come the guy at the end couldn't use his clone for an eye replacement? And is it really that great in America? They tell me I'm to go there soon.

While I agree for the most part on the Michael Bay judgement, I must admit that I'm hoping he can redeem himself with the Transformers movie. But I'm probably just going to be disappointed yet again by the vacuousness of the Hollywood machine.
