travis and everyone else - should this become a stream-likelihood thread too? Asking related to the twitch marathon and, well, Shout is really good at distribution, including Digital.

Streaming is tricky. Some episodes are available on certain platforms, but not others, while others aren't available at all.
It might be more feasible for Travis to maybe add a blurb as to who owns certain movies that aren't available for streaming.

Fair point - I’m ok with only focusing on Shout’s “current” streamable eps

I actually came here exactly to suggest the same thing ern2150 did. A MISTIE figured out and made a Google Sheets doc which list which episodes are streaming on ShoutFactoryTV and MST3K's Twitch Channel. travis, I went ahead and created a ' MST3K Episode Release & Distrib Info' Google Sheet for the above to get us started:. You are free to copy/paste it to own copy to post, fill in the blanks (since you're very familiar with the rights stuff) and share in the main thread. I'll remove my link once you get it up and running.

I've actually done a somewhat similar spreadsheet, where I listed what MST3K episodes are available on DVD and their volumes. This is more of a personal project, as it also has my ratings for certain episodes. However, I could potentially help with your episode release spreadsheet. My signature has the link to it.

One wonders, does Shout's unriffed releases of Incredible Melting Man and Squirm going out of print spell doom for those MST3K volumes?

I know this shouldn't be treated as definitive proof of a future release. However, Shout Factory just posted a clip from the MST3k episode of The Amazing Colossal Man on their official MST3k YouTube channel. I'm not completely sold, but those rumors that Susan Hart has finally struck a deal with a releasing label are giving me hope, given Shout knows how litigious she is. EDIT: Also, looks like Shout Factory is releasing a Blu-ray edition of the AIP Roger Corman film "The Day The World Ended" (used in MST3k: The Home Game on Sci-Fi Channel). Makes sense, since Shout is listed as digital streaming rights holder for this film and other Arkoff AIP films. Hopefully they secured the rights to the Susan Hart AIP films and are releasing on Blu-ray along with the Arkoff collection. www.amazon.com/World-Ended-Blu-ray-Richard-Denning/dp/B082BWZJF7/ref=as_sl_pc_tf_til?tag=tapatalk02-20&linkCode=w00&linkId=&creativeASIN=B082BWZJF7

Looks like there have been developments in Susan Hart's suit against Shout Factory, BallyHoo Motion Pictures, and Daniel Griffin. www.courtlistener.com/docket/14661252/susan-nicholson-hofheinz-v-shout-factory-llc/Diet Kolos, you have a Pacer account. You were able to access the court case documents earlier this year. What do the most recent documents say? EDIT: From the summaries posted about this case on other legal sites, it appears that Susan Hart made a settlement in the case, filed and announced on September 24 about. This timeline lines up well with that rumor about the Hart films being licensed in late October on that Blu-ray forum site. I think this is a good sign Shout Factory took their favorable position to win the case as an opportunity make a deal with Hart.

I'm not sure if I remember the login info for the other one, I'll try later. But if they reached a settlement in mediation, the specifics probably weren't included in the filings. But I'd say the odds of her finally agreeing to licensing may have gone up.

Ok, quick rundown of events.
After the initial mediation, apparently nothing came of it and Shout Factory applied for a motion for summary judgment. Essentially saying that Susan has no case, fair use, it should be dismissed, etc.
Shout et al argued that Susan: 1. Has not proved ownership or renewal on the copyrights of said films. 2. The clips used were under Fair Use. And most interestingly 3. Susan has not sought to actively protect her works, as a quick Google search will show YouTube uploads of the full films she claims Shout infringed on. Meaning she isn't actively protecting the copyright on her works.
Then, Susan came back with a settlement in September. The settlement is very brief, but it says that an agreement has been reached in principle. Meaning that it hasn't actually been finalized. An interesting quote: This settlement will resolve this matter in its entirety."
There was that a 45-day time limit set for Susan to come back to the court and request the case be dismissed because the settlement has been finalized, or request an extension of time because they are still working on it. Susan has filed 2 such extensions, the last one actually occurring yesterday. So whatever Shout and Susan are working on, it's still being negotiated.

Thanks for the ongoing updates on this, guys. What's unfolding here is potentially the most interesting development on the MST3K licensing front in years.

An interesting tidbit in the filings from Jordan Fields is that Shout entered negotiations for the rights to Susan's films in 2010-2011 & 2016-2017. He also calls MST3K their "primary property".
LOTS of info on the financials of a set. As of Dec 18, Volume 34 sold ~8300 units. Total revenue ~$302,000. Net profit only ~$12,000 after all costs (including $26,000 in royalty fees)
